Living on rent provides both the landlord and the tenant with a series of rights and obligations that should be known and demanded if necessary. For example, who is responsible for paying for repairs? Is it legal for the landlord to enter the home as he pleases? In this article we review the rights and obligations of both the tenant and the owner when renting.
The owner does not have the right to enter the property without the permission of the tenant : If he does so, the court could be asked to terminate the contract and even Phone Lead denounce it because, as stated in the Constitution, the home is inviolable. Not even having a monthly payment pending gives the owner the right to break into the home.
Right of the tenant to extend the rental contract : Once the rental contract expires , it will be extended for another three years annually, unless the tenant notifies his or her desire not to renew it.
Leaving the home after six months is part of the rights of a tenant : The tenant can leave the home after six months from the signing of the contract, regardless of the time agreed upon in it. This is established by the Urban Leasing Law (LAU), although this must be communicated to the owner at least 30 days in advance.
Right of the tenant to ask the landlord for the repairs necessary to preserve the home : The repairs will be borne by the owner as long as the tenant has not been the cause of its deterioration and, furthermore, the tenant will not be able to increase the rent as a result.
If the house is sold, the tenant has the right to have preference over other potential buyers: Another of the tenants' rights by law is that of trial and withdrawal. That is, you have preference over third parties to buy the home you live in if the owner chooses to sell it, as long as the contract does not exclude this possibility.
The tenant has the right to demand receipt of payment of the rent : The tenant may demand from the owner of the house a receipt or written proof that proves that he has paid the rent, as established in article 17 of the LAU . Payment formulas that prove payment of rent, such as account deposit or bank transfer, are excluded.
Tenant's right to return the deposit : The tenant has the right to have the deposit returned once the contract ends, as long as the property is in good condition and all payments are up to date.
Carrying out works to adapt the house due to disability is a right that the tenant opts for : The tenant has the option of carrying out renovations inside the home , as long as he or she notifies the owner in advance, in case he, his or her spouse or people or family members who permanently reside in the home have a disability or are over 70 years of age.
These modifications must not affect common elements or services of the building, nor compromise its stability or safety. At the end of the contract, the tenant must restore the home to its original state if the owner requests it.
The tenant has the right to opt for a reduction in rent in exchange for improvements to the house : In rental contracts, the parties are free to agree that, during a specific period, the tenant can totally or partially replace their payment obligation through the commitment to carry out renovations or rehabilitations in the property, according to the established terms and conditions.
Right of the tenant to continue in the home if the owner changes : Tenants who live in houses with rental contracts registered in the Property Registry and that are occupied by themselves, their spouses who are not legally or de facto separated, or their children dependents, have the right to continue with the rental contract under the same conditions and responsibilities, even in the event of a change of owner.
